Frilot Obtains Favorable Jury Verdict for Insurance Client

Frilot attorneys Norman C. Sullivan, Jr. and W. Jacob Gardner, Jr. recently obtained a favorable jury verdict in Tangipahoa Parish for Great American Insurance Company (“Great American”).  The plaintiff sought recovery for alleged orthopedic and traumatic brain injuries after being involved in a motor vehicle accident with a tractor-trailer on Interstate 55.  Great American issued an excess insurance policy in favor of the tractor-trailer operator with a $2 million attachment point.  Great American challenged the nature and extent of the plaintiff’s orthopedic injuries and argued the traumatic brain injury claim was not legitimate. 

During the closing arguments, the plaintiff’s counsel asked for $3.3 million in damages.  In contrast, Great American suggested that $275,000 was appropriate compensation for the plaintiff’s orthopedic injuries.  The jury rejected the traumatic brain injury claim and returned a verdict for $300,000, a figure well below the attachment point for Great American’s excess insurance policy.
